Terms of Service
1. Scope of Service
This website functions as an online portfolio and enquiry platform for custom artwork and original pieces by Rebecca Carrozza. This website is not an automated e-commerce store; no checkout processing happens natively on these web pages.
2. Inquiry, Order Authentication, and Temporary Reserves
Initial Contact: Order requests are initiated when a visitor submits their name, email, and shipping address via the web enquiry form.
Authentication Rights: The artist reserves the exclusive right to vet, judge, and determine the authenticity of any digital enquiry received. Enquiries deemed suspicious, fraudulent, or non-genuine will be discarded without response or notice.
Temporary Allocation: Upon receiving a valid, authenticated enquiry regarding an available original artwork, the piece may be temporarily reserved and held for that client.
Holding Limits: This reserve is a courtesy and is strictly limited to a timeframe specified by the artist during email correspondence. If communication lapses or payment is not cleared within this allocated window, the hold will expire automatically, the invoice will be cancelled, and the artwork will be released back for public sale.
Contract Formation: No formal contract or transaction obligation exists until the external PayPal deposit or full invoice payment has been cleared.
3. Pricing and Payments
Rates: All quotes provided via email are tailored to individual project specifications and remain valid for 30 days from issuance.
Payment Processing: All financial data entry occurs exclusively on PayPal’s external secure platform. The artist never collects, views, or archives your banking or credit card details.
Clearing: Custom projects will not commence, and completed physical pieces will not ship, until verified payment clearance is confirmed by the processor.
4. Intellectual Property Rights
Copyright Ownership: Rebecca Carrozza retains full copyright and intellectual property rights over all original creations, commission sketches, and finalised artworks.
Usage Restrictions: Purchases grant the client ownership of the physical piece for personal display only. No artwork may be reproduced, resold, or used for commercial purposes without explicit, written licensing agreements.
Returns & Refund Policy
1. Custom and Commissioned Artwork
Exempt Status: Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, custom-made, personalised, and commissioned goods are explicitly exempt from standard statutory cancellation rights.
Final Sale: Once a custom commission project has been initiated or paid for via your external PayPal link, the order cannot be cancelled, amended, or returned due to a change of mind.
2. Non-Commissioned Original Work
If you purchase an existing, pre-completed original artwork via an external invoice link, the following standard UK consumer protections apply:
Cooling-Off Window: You have a legal right to change your mind and request a return within 14 days of the item being delivered to your shipping address.
Return Procedure: To log a return request, you must email hello@rebecca-carrozza.co.uk within this 14-day frame to receive return delivery validation.
Return Transit Costs: The buyer is entirely responsible for organising and funding secure, tracked, and insured return postage.
Item Condition: Items must return in their original, immaculate, and undamaged condition. Refunds will be issued via PayPal within 14 days of the artist safely receiving the returned piece.
3. Damaged or Faulty Deliveries
Transit Damage: In the rare event that an artwork arrives damaged during postal transit, you must report the issue within 48 hours of delivery by emailing hello@rebecca-carrozza.co.uk.
Evidence Required: Your email must include clear photographic evidence of both the damaged exterior packaging and the impacted artwork.
Resolution: Validated transit damage claims will be resolved via a full refund, repair, or a mutually agreed replacement piece.
